What is professional tax and who pays it

Professional tax is a direct tax levied by state governments on individuals earning income through salary, profession, trade, or employment. Despite the name, it applies to all income earners — not just traditional "professionals." A factory worker, a software engineer, a CA, and a doctor can all be liable to pay professional tax if they earn above the state's threshold in a state that levies it.

Employer obligations (PTRC — Professional Tax Registration Certificate): Employers must deduct PT from employees' monthly salaries and remit to the state government. They need a PTRC (Professional Tax Registration Certificate) for this.

Individual/ business obligations (PTEC — Professional Tax Enrollment Certificate): Self-employed professionals, freelancers, company directors, partners, and businesses as legal entities must enroll separately and pay their own PT directly. This requires a PTEC.

A company with employees typically needs both PTRC and PTEC. Missing PTEC while holding PTRC (or vice versa) is the single most common professional tax audit finding.

States that do not levy professional tax

Not all Indian states levy professional tax. Employers and employees in these states do not need PT registration or login:

  • Rajasthan
  • Uttar Pradesh
  • Uttarakhand
  • Delhi (Union Territory)
  • Haryana
  • Bihar
  • Arunachal Pradesh
  • Nagaland
  • Mizoram
  • Manipur
  • Meghalaya

If your company has employees across multiple states — some PT states and some non-PT states — PT compliance is required only for employees working in PT-levy states.

General steps for PT new registration (PTRC/ PTEC)

Before you can log in, you need to register. The general online registration process (varies by state):

  1. Visit the state's PT or commercial tax portal
  2. Select "New Registration" — choose PTEC (for self/own PT) or PTRC (for employer deducting from employees)
  3. Fill the application form with: business name, PAN, Aadhaar, GSTIN, address, nature of business
  4. Upload documents: PAN card, Aadhaar, GST registration, address proof, incorporation documents
  5. Submit the application
  6. Receive your PT TIN (or Login ID) after approval — typically 2–5 working days for online registrations
  7. Use the TIN/ Login ID to access the portal for return filing and payment

PT certificate for employees (reflected in Form 16/ Form 130)

For salaried employees, the PT deducted by the employer appears in the annual TDS certificate — Form 16 (for FY 2025–26) or Form 130 (for Tax Year 2026–27 onwards). Employees do not need to separately log in to any PT portal — the employer handles deduction and remittance. However, employees should verify that their Form 16/Form 130 correctly reflects the PT deducted.

Under the old income tax regime, PT paid by the employee is deductible from gross salary under Section 16(iii) of the Income Tax Act — a small but legitimate deduction of up to Rs. 2,500 per year.

Frequently Asked Questions

Registration and compliance

What is the professional tax login portal for Maharashtra?

mahagst.gov.in — under e-Payments → Return Payment. Select PTRC or PTEC Act, enter your PT TIN, select the period, and pay through net banking by the 15th of the following month.

What is the Karnataka professional tax login portal?

ptax.karnataka.gov.in — the e-Prerana portal. Click Employer Login for PTRC; Enrolment Login for PTEC.

I don't have my PT TIN — how do I log in?

Your PT TIN is issued in the registration certificate (PTRC/PTEC certificate) issued at the time of registration. If you have lost it, contact the state's commercial tax department helpdesk with your business PAN or GSTIN to retrieve it.

Do I need both PTRC and PTEC?

If you run a business and have employees, yes — PTRC for deducting and remitting employee PT; PTEC for the company's own PT as a legal entity. Operating with only one is a compliance gap and a common audit finding.

Is professional tax applicable in my state?

Check whether your state is on the list of PT-levy states: Maharashtra, Karnataka, Gujarat, West Bengal, Tamil Nadu, Telangana, Andhra Pradesh, Assam, Jharkhand, Kerala, Odisha, and others levy PT. Rajasthan, UP, Delhi, Haryana, Bihar, and several north-east states do not.

Is professional tax deductible for income tax purposes?

Yes — under Section 16(iii) of the Income Tax Act (old regime), PT paid during the year is deductible from gross salary. Under the new tax regime, this deduction is not available.
